Notice of Settlement of a Recovery Action for Response Costs

The State of Texas gives notice of the following proposed resolution of an action to recover costs under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Before the State may enter into a voluntary settlement agreement, pursuant to section 7.110 of the Texas Water Code, the State shall permit the public to comment in writing. The Attorney General will consider any written comments and may withdraw or withhold consent to the proposed agreement if the comments disclose facts or considerations indicating that consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the law.

Case Title: State of Texas v. Hydro Resources Corporation; Case No. 5:25-cv-00236-H, in the United States District Court for the Northern District of Texas.

Background: On October 31, 2025, the State of Texas filed a Complaint against Hydro Resources Corporation (Hydro) for cost recovery under Section 107 of CERCLA, 42 U.S.C. § 9607, related to response and cleanup actions taken at a site in Anton, Texas. The Complaint alleges that Hydro is liable under CERCLA for costs incurred by the Texas Commission on Environmental Quality (TCEQ) in connection with response actions taken at the site in Anton, which was formerly operated by Bulldog Services, LLC. Specifically, Hydro stored six drums containing cyanide waste on the site, at least some of which were uncovered, posing a threat to public health and the environment. TCEQ spent $32,850.35 to remove the drums from the site and arrange for their transportation and disposal.

Proposed Settlement: Hydro will pay $26,000 to the State under the proposed Consent Decree. Of this total, $25,000 is designated as reimbursement for the response costs, and $1,000 is designated as the State's reasonable attorney's fees.

Notice of Update to the Texas Private Real Property Rights Preservation Act Guidelines

The Office of the Attorney General intends to revise the Texas Private Real Property Rights Preservation Act Guidelines (the Guidelines) found on the Office's website and is publishing the proposed changes in the Texas Register for 30 days so that the Office may accept public comment regarding the proposed settlement.

Under section 2007.041 of the Texas Government Code, the Attorney General must (1) prepare guidelines to assist governmental entities in identifying and evaluating governmental actions described in section 2007.003(a)(1)-(3) that may result in a taking, (2) file the guidelines with the Secretary of State for publication in the Texas Register in the manner prescribed by chapter 2002 of the Texas Government Code, and (3) review the guidelines at least annually and revise the guidelines as necessary to ensure consistency with the actions of the Texas Legislature and the decisions of the United States Supreme Court and the Texas Supreme Court. The Office of the Attorney General thus intends to revise and update the Guidelines as indicated herein and will accept public comment on the proposed changes.

In 2024, the Texas Supreme Court issued its decision in Texas Department of Transportation v. Self, 690 S.W.3d 12 (Tex. 2024), which clarified the elements of a taking and specified the requisite intent for a taking. Specifically, the Court stated that, for a taking to occur, certain acts must result "in taking, damaging, or destroying the property for, or applying it to . . . public use." Id. at 26. Further, the Court stated that a governmental entity's mistaken belief regarding the legal right to take a specific action does not, in and of itself, exempt that action as a taking: "[T]he government must pay compensation when it intentionally takes private property for public use--even if the government mistakenly believes that it has a legal right to do so apart from its power of eminent domain." Id. at 29.

The Office of the Attorney General proposes to update the Guidelines to reflect the decision in Self in two ways. The first proposed update would specify that taking may result from actions that, in addition to taking property, result in the damage or destruction of property. The second update spells out the clarification in Self that a mistaken belief does not exempt an action from being a taking. No other actions or decisions of the Texas Legislature, United States Supreme Court, or Texas Supreme Court warrant any update to the Guidelines.

Certification of the Average Closing Price of Gas and Oil - November 2025

The Comptroller of Public Accounts, administering agency for the collection of the Oil Production Tax, has determined, as required by Tax Code, §202.058, that the average taxable price of oil for reporting period November 2025 is $37.58 per barrel for the three-month period beginning on August 1, 2025, and ending October 31, 2025. Therefore, pursuant to Tax Code, §202.058, oil produced during the month of November 2025, from a qualified low-producing oil lease, is not eligible for credit on the oil production tax imposed by Tax Code, Chapter 202. Due to a lack of consumer price index (CPI) data for October 2025, the Comptroller utilized the CPI data from September 2025 when calculating the 2005 price for the month of October 2025.

The Comptroller of Public Accounts, administering agency for the collection of the Natural Gas Production Tax, has determined, as required by Tax Code, §201.059, that the average taxable price of gas for reporting period November 2025 is $1.22 per mcf for the three-month period beginning on August 1, 2025, and ending October 31, 2025. Therefore, pursuant to Tax Code, §201.059, gas produced during the month of November 2025, from a qualified low-producing well, is eligible for a 100% credit on the natural gas production tax imposed by Tax Code, Chapter 201. Due to a lack of consumer price index (CPI) data for October 2025, the Comptroller utilized the CPI data from September 2025 when calculating the 2005 price for the month of October 2025.

The Comptroller of Public Accounts, administering agency for the collection of the Franchise Tax, has determined, as required by Tax Code, §171.1011(s), that the average closing price of West Texas Intermediate crude oil for the month of November 2025 is $59.48 per barrel. Therefore, pursuant to Tax Code, §171.1011(r), a taxable entity shall not exclude total revenue received from oil produced during the month of November 2025, from a qualified low-producing oil well.

The Comptroller of Public Accounts, administering agency for the collection of the Franchise Tax, has determined, as required by Tax Code, §171.1011(s), that the average closing price of gas for the month of November 2025 is $4.64 per MMBtu. Therefore, pursuant to Tax Code, §171.1011(r), a taxable entity shall exclude total revenue received from gas produced during the month of November 2025, from a qualified low-producing gas well.

Application and Draft Permit. Plainsman Company LLC, 2901 Avenue A, Lubbock, Texas 79404-2231, a soybean and other oilseed processing facility, has applied to the TCEQ for an Initial Issuance of Federal Operating Permit (herein referred to as permit) No. O4775, Application No. 38395 to authorize operation of the Plainsman Avenue A Facility. The area addressed by the application is located at 2901 Avenue A in Lubbock, Lubbock County, Texas 79404-2231. This application was received by the TCEQ on June 19, 2025.

The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if approved, will codify the conditions under which the site must operate. The TCEQ Executive Director recommends issuance of the draft permit. The purpose of a federal operating permit is to improve overall compliance with the rules governing air pollution control by clearly listing all applicable requirements, as defined in Title 30 Texas Administrative Code (30 TAC) §122.10. The permit will not authorize new construction or new emissions.

Notice and Comment Hearing. The hearing will be structured for the receipt of oral or written comments by interested persons. Registration and an informal discussion period with commission staff members will begin during the first 30 minutes. During the informal discussion period, the public is encouraged to ask questions and engage in open discussion with the applicant and the TCEQ staff concerning this application and draft permit. Issues raised during this discussion period will only be addressed in the formal response to comments if the issue is also presented during the hearing. After the conclusion of the informal discussion period, the TCEQ will conduct a notice and comment hearing regarding the application and draft permit. Individuals may present oral statements when called upon in order of registration. A reasonable time limit may be established at the hearing to assure that enough time is allowed for every interested person to speak. There will be no open discussion during the hearing. The purpose of this hearing will be to receive formal public comment which the TCEQ will consider in determining whether to revise and/or issue the permit and in determining the accuracy and completeness of the permit. Notice of a Public Meeting and a Proposed Renewal with Amendment of General Permit TXG870000 Authorizing the Discharge of Pesticides

The Texas Commission on Environmental Quality (TCEQ or commission) is proposing to renew and amend Texas Pollutant Discharge Elimination System General Permit TXG870000. This general permit authorizes the application of pesticides (including insecticides, nematicides, rodenticides, fungicides, and herbicides) into or over, including near, waters of the United States. The draft general permit applies to the entire state of Texas. This general permit is authorized by Section 402 of the Clean Water Act (CWA) and Chapter 26 of the Texas Water Code.

DRAFT GENERAL PERMIT. The executive director has prepared a draft pesticide general permit renewal with amendments and the pesticide use patterns covered under this permit include mosquito and other nuisance insect pests, vegetation and algae, nuisance animal, area-wide and forest canopy pest control. No significant degradation of high quality waters is expected and existing uses will be maintained and protected. The executive director proposes to require certain dischargers to submit a Notice of Intent to obtain authorization to discharge.

The executive director has reviewed this action for consistency with the goals and policies of the Texas Coastal Management Program (CMP) according to General Land Office regulations and has determined that the action is consistent with applicable CMP goals and policies.

On the date that this notice is published, a copy of the draft general permit and fact sheet will be available for a minimum of 30 days for viewing and copying at the TCEQ Office of the Chief Clerk located at the TCEQ Austin office, at 12100 Park 35 Circle, Building F. According to the petition, a preliminary investigation has been made to determine the cost of the project, and it is estimated by the Petitioner that the cost of said project will be approximately $21,515,000 ($14,355,000 for water, wastewater, and drainage, $7,160,000 for roads).

Additional work and services which may be performed by the District include the purchase, construction, acquisition, provision, operation, maintenance, repair, improvement, extension and development of a roadway system for the District. The Texas Health and Human Services Commission (HHSC) is submitting a request to the Centers for Medicare & Medicaid Services (CMS) to renew the Non-Emergency Medical Transportation (NEMT) Statewide Fee-for-Service (FFS) Selective Contracting waiver authorized under §1915(b)(4) of the Social Security Act (the Act). HHSC provides NEMT services under the Texas Medicaid state plan, and CMS approved HHSC's waiver through May 31, 2026, for the NEMT FFS Selective Contracting program which limits choice of demand response transportation service (DRTS) providers. The proposed effective date for this renewal is June 1, 2026.

HHSC intends to continue to selectively contract with providers for the provision of NEMT FFS DRTS to the Medicaid FFS population in the State of Texas. DRTS is considered transportation that involves using contractor dispatched vehicles in response to on-demand requests for individual or shared one-way trips. The utilization of selective contracts affords HHSC the ability to continue the uninterrupted delivery of DRTS to Medicaid-eligible clients.

Services for clients in FFS will remain unchanged. HHSC will ensure DRTS are available statewide, are similar in scope and duration for all eligible clients, consistent with the best interest of clients, appropriate to available services, geographic locations, and limitation of clients, reasonably prompt, and administratively efficient.

This renewal specifies HHSC has management and operational oversight for the statewide FFS DRTS. The changes in this renewal include the following: this renewal identifies individuals receiving retroactive eligibility as an excluded population only during the period of retroactive enrollment; this renewal updates the approximate number of Medicaid FFS clients that are eligible for NEMT services and the approximate total of clients that use FFS NEMT services. HHSC also updated the number of participants where appropriate. This renewal includes an updated provider capacity analysis spreadsheet. Outdated language was also removed or edited. For example, language regarding the planned termination of medical transportation organizations (MTOs) was updated as the terminations were completed during the implementation of the initial waiver. This renewal updates the monitoring frequency of providers from monthly to quarterly. HHSC also updated the projected waiver expenditures for the renewal period.

The Texas Health and Human Services Commission (HHSC) is submitting a request to the Centers for Medicare & Medicaid Services (CMS) to amend the waiver application for the Deaf Blind with Multiple Disabilities (DBMD) program. HHSC administers the DBMD Program under the authority of Section 1915(c) of the Social Security Act. CMS has approved the DBMD waiver application through February 29, 2028. The proposed effective date for this amendment is February 28, 2026. This amendment proposes to make the following changes:

Appendix B

HHSC updated waiver year (WY) three (March 1, 2025 through February 28, 2026) through WY five (March 1, 2027 through February 28, 2028) to reflect an increase in the Point-in-Time (PIT) and unduplicated participants (Factor C).

Appendix J

HHSC revised the unduplicated number of participants (Factor C) and PIT calculations for the overall projected cost of waiver services (Factor D) and the overall projected cost of other Medicaid services furnished to waiver participants (D Prime (D')) for waiver years (WYs) three through five. HHSC also updated the average length of stay as a result of the updated Factor C and PIT calculations.

The DBMD waiver program provides essential home and community-based services and supports to individuals with legal blindness, deafness, or a condition that leads to deafblindness, and at least one additional disability that limits functional abilities and who live in their own homes or in the home of another person, such as a family member or in a small group home setting. Services and supports are intended to enhance quality of life, functional independence, health and welfare, and to supplement, rather than replace, existing informal or formal supports and resources. Services in the DBMD waiver program are case management, residential habilitation, respite (in-home and out of home), supported employment, prescribed medications, financial management services, support consultation, adaptive aids and medical supplies, assisted living, audiology services, behavioral support, chore services, dental treatment, dietary services, employment assistance, intervener, minor home modifications, nursing, occupational therapy services, orientation and mobility, physical therapy services, speech, hearing and language therapy, transition assistance services, employment readiness and individualized skills and socialization.

Notice of Opportunity to Comment on Proposed Field of Study Curriculum for Computer Science

The Texas Higher Education Coordinating Board (Coordinating Board) staff is providing an opportunity for written public comment on the revision of the Field of Study Curriculum (FOSC) for Computer Science.

Texas Education Code (TEC) Chapter 61, Subchapter S, establishes policies to facilitate statewide transfer, including the FOSC. Institutions must accept partially or fully completed Field of Study Curricula for academic credit toward the degree program in which the transfer student enrolls (TEC §61.823). The Coordinating Board has promulgated rules related to transfer policy in 19 Texas Administrative Code (TAC) Chapter 1, Subchapter V, and Chapter 4, Subchapter B. Posting requirements may be found in 19 TAC §§4.33(f) and 1.239(b).

The Computer Science Discipline-Specific Subcommittee met on November 3, 2025, and November 4, 2025, to consider and make recommendations to the Texas Transfer Advisory Committee regarding the FOSC for this discipline using the alternative FOSC framework as outlined in 19 TAC §4.32(d). On December 8, 2025, the Texas Transfer Advisory Committee adopted the subcommittee recommendations for the designated Texas Core Curriculum courses and the Discipline Foundation Courses and recommended their submission to the Commissioner of Higher Education for final approval.

A prize winner in the "LUCKY 7s TRIPLER" Scratch Ticket Game is determined once the latex on the Scratch Ticket is scratched off to expose forty-eight (48) Play Symbols. BONUS: If a player reveals 2 matching Play Symbols in the BONUS, the player wins the prize. LUCKY 7s TRIPLER: If a player matches any of the YOUR NUMBERS Play Symbols to any of the WINNING NUMBERS Play Symbols, the player wins the prize for that number. If a player reveals a "7" Play Symbol, the player wins the prize for that symbol instantly. If a player reveals a "777" Play Symbol, the player wins TRIPLE the prize for that symbol. 2.1 Scratch Ticket Validation Requirements.

A. To be a valid Scratch Ticket, all of the following requirements must be met:

1. Exactly forty-eight (48) Play Symbols must appear under the Latex Overprint on the front portion of the Scratch Ticket;

2. Each of the Play Symbols must have a Play Symbol Caption underneath, unless specified, and each Play Symbol must agree with its Play Symbol Caption;

3. Each of the Play Symbols must be present in its entirety and be fully legible;

4. Each of the Play Symbols must be printed in black ink except for dual image games;

5. The Scratch Ticket shall be intact;

6. The Serial Number and Game-Pack-Ticket Number must be present in their entirety and be fully legible;

7. The Serial Number must correspond, using the Texas Lottery's codes, to the Play Symbols on the Scratch Ticket;

8. The Scratch Ticket must not have a hole punched through it, be mutilated, altered, unreadable, reconstituted or tampered with in any manner;

9. The Scratch Ticket must not be counterfeit in whole or in part;

10. The Scratch Ticket must have been issued by the Texas Lottery in an authorized manner;

11. The Scratch Ticket must not have been stolen, nor appear on any list of omitted Scratch Tickets or non-activated Scratch Tickets on file at the Texas Lottery;

12. The Play Symbols, Serial Number and Game-Pack-Ticket Number must be right side up and not reversed in any manner;

B. The Scratch Ticket must pass all additional validation tests provided for in these Game Procedures, the Texas Lottery's Rules governing the award of prizes of the amount to be validated, and any confidential validation and security tests of the Texas Lottery.

C. Any Scratch Ticket not passing all of the validation requirements is void and ineligible for any prize and shall not be paid. However, the Executive Director of the Texas Lottery ("Executive Director") may, solely at the Executive Director's discretion, refund the retail sales price of the Scratch Ticket. In the event a defective Scratch Ticket is purchased, the only responsibility or liability of the Texas Lottery shall be to replace the defective Scratch Ticket with another unplayed Scratch Ticket in that Scratch Ticket Game (or a Scratch Ticket of equivalent sales price from any other current Texas Lottery Scratch Ticket Game) or refund the retail sales price of the Scratch Ticket, solely at the Executive Director's discretion.

2.2 Programmed Game Parameters.

A. GENERAL: Consecutive Non-Winning Tickets within a Pack will not have matching patterns, in the same order, of either Play Symbols or Prize Symbols.

B. GENERAL: A Ticket can win as indicated by the prize structure.

C. GENERAL: A Ticket can win up to twenty-one (21) times.

D. GENERAL: On winning and Non-Winning Tickets, the top cash prizes of $1,000 and $100,000 will each appear at least one (1) time, except on Tickets winning twenty-one (21) times, with respect to other parameters, play action or prize structure.

E. GENERAL: The "7" (WIN$) or "777" (TRP) Play Symbols will never appear in the BONUS play area.

F. BONUS: A Ticket can win up to one (1) time in the BONUS play area.

G. BONUS: The BONUS play area will consist of two (2) Play Symbols and one (1) Prize Symbol.

H. BONUS: Winning Tickets will have two (2) matching Play Symbols in the BONUS play area.

I. BONUS: A non-winning BONUS play area will have two (2) different Play Symbols.

J. LUCKY 7s TRIPLER: A Ticket can win up to twenty (20) times in the main play area.

K. LUCKY 7s TRIPLER: All non-winning YOUR NUMBERS Play Symbols will be different.

L. LUCKY 7s TRIPLER: Non-winning Prize Symbols will never match a winning Prize Symbol on a Ticket.

M. LUCKY 7s TRIPLER: Tickets winning more than one (1) time will use as many WINNING NUMBERS Play Symbols as possible to create matches, unless restricted by other parameters, play action or prize structure.

N. LUCKY 7s TRIPLER: No matching WINNING NUMBERS Play Symbols will appear on a Ticket.

O. LUCKY 7s TRIPLER: All YOUR NUMBERS Play Symbols will never equal the corresponding Prize Symbol (i.e., 05 and $5, 10 and $10, 15 and $15, 20 and $20 and 30 and $30).

P. LUCKY 7s TRIPLER: On all Tickets, a Prize Symbol will not appear more than three (3) times, except as required by the prize structure to create multiple wins.

Q. LUCKY 7s TRIPLER: On Non-Winning Tickets, a WINNING NUMBERS Play Symbol will never match a YOUR NUMBERS Play Symbol.

R. LUCKY 7s TRIPLER: The "7" (WIN$) Play Symbol will never appear on the same Ticket as the "777" (TRP) Play Symbol.

S. LUCKY 7s TRIPLER: The "7" (WIN$) Play Symbol will win the prize for that Play Symbol.

T. LUCKY 7s TRIPLER: The "7" (WIN$) Play Symbol will never appear more than one (1) time on a Ticket.

U. LUCKY 7s TRIPLER: The "7" (WIN$) Play Symbol will never appear on a Non-Winning Ticket.

V. LUCKY 7s TRIPLER: The "7" (WIN$) Play Symbol will never appear as a WINNING NUMBERS Play Symbol.

W. LUCKY 7s TRIPLER: The "777" (TRP) Play Symbol will never appear more than one (1) time on a Ticket.

X. LUCKY 7s TRIPLER: The "777" (TRP) Play Symbol will win TRIPLE the prize for that Play Symbol and will win as per the prize structure.

Y. LUCKY 7s TRIPLER: The "777" (TRP) Play Symbol will never appear on a Non-Winning Ticket.

Z. LUCKY 7s TRIPLER: The "777" (TRP) Play Symbol will never appear as a WINNING NUMBERS Play Symbol.

2.3 Procedure for Claiming Prizes.

A. To claim a "LUCKY 7s TRIPLER" Scratch Ticket Game prize of $5.00, $10.00, $15.00, $20.00, $30.00, $50.00, $100, $250 or $500, a claimant shall sign the back of the Scratch Ticket in the space designated on the Scratch Ticket and may present the winning Scratch Ticket to any Texas Lottery Retailer. The Texas Lottery Retailer shall verify the claim and, if valid, and upon presentation of proper identification, if appropriate, make payment of the amount due the claimant and physically void the Scratch Ticket; provided that the Texas Lottery Retailer may, but is not required, to pay a $30.00, $50.00, $100, $250 or $500 Scratch Ticket Game. In the event the Texas Lottery Retailer cannot verify the claim, the Texas Lottery Retailer shall provide the claimant with a claim form and instruct the claimant on how to file a claim with the Texas Lottery. If the claim is validated by the Texas Lottery, a check shall be forwarded to the claimant in the amount due. In the event the claim is not validated, the claim shall be denied and the claimant shall be notified promptly. A claimant may also claim any of the above prizes under the procedure described in Section 2.3.B and Section 2.3.C of these Game Procedures.

B. To claim a "LUCKY 7s TRIPLER" Scratch Ticket Game prize of $1,000 or $100,000, the claimant must sign the winning Scratch Ticket and may present it at one of the Texas Lottery's Claim Centers. If the claim is validated by the Texas Lottery, payment will be made to the bearer of the validated winning Scratch Ticket for that prize upon presentation of proper identification. When paying a prize of $600 or more, the Texas Lottery shall file the appropriate income reporting form with the Internal Revenue Service (IRS) and shall withhold federal income tax at a rate set by the IRS if required. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.

C. As an alternative method of claiming a "LUCKY 7s TRIPLER" Scratch Ticket Game prize, the claimant may submit the signed winning Scratch Ticket and a thoroughly completed claim form via mail. If a prize value is $1,000,000 or more, the claimant must also provide proof of Social Security number or Tax Payer Identification (for U.S. Citizens or Resident Aliens). Mail all to: Texas Lottery, P.O. Box 16600, Austin, Texas 78761-6600. The Texas Lottery is not responsible for Scratch Tickets lost in the mail. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.

D. Prior to payment by the Texas Lottery of any prize, the Texas Lottery shall deduct the amount of a delinquent tax or other money from the winnings of a prize winner who has been finally determined to be:

1. delinquent in the payment of a tax or other money to a state agency and that delinquency is reported to the Comptroller under Government Code §403.055;

2. in default on a loan made under Chapter 52, Education Code;

3. in default on a loan guaranteed under Chapter 57, Education Code; or

4. delinquent in child support payments in the amount determined by a court or a Title IV-D agency under Chapter 231, Family Code.

E. If a person is indebted or owes delinquent taxes to the State, other than those specified in the preceding paragraph, the winnings of a person shall be withheld until the debt or taxes are paid.

2.4 Allowance for Delay of Payment. The Texas Lottery may delay payment of the prize pending a final determination by the Executive Director, under any of the following circumstances:

A. if a dispute occurs, or it appears likely that a dispute may occur, regarding the prize;

B. if there is any question regarding the identity of the claimant;

C. if there is any question regarding the validity of the Scratch Ticket presented for payment; or

D. if the claim is subject to any deduction from the payment otherwise due, as described in Section 2.3.D of these Game Procedures. No liability for interest for any delay shall accrue to the benefit of the claimant pending payment of the claim.

2.5 Payment of Prizes to Persons Under 18. If a person under the age of 18 years is entitled to a cash prize under $600 from the "LUCKY 7s TRIPLER" Scratch Ticket Game, the Texas Lottery shall deliver to an adult member of the minor's family or the minor's guardian a check or warrant in the amount of the prize payable to the order of the minor.

2.6 If a person under the age of 18 years is entitled to a cash prize of $600 or more from the "LUCKY 7s TRIPLER" Scratch Ticket Game, the Texas Lottery shall deposit the amount of the prize in a custodial bank account, with an adult member of the minor's family or the minor's guardian serving as custodian for the minor.

2.7 Scratch Ticket Claim Period. All Scratch Ticket prizes must be claimed within 180 days following the end of the Scratch Ticket Game or within the applicable time period for certain eligible military personnel as set forth in Texas Government Code §466.408. Any rights to a prize that is not claimed within that period, and in the manner specified in these Game Procedures and on the back of each Scratch Ticket, shall be forfeited.

2.8 Disclaimer. The number of prizes in a game is approximate based on the number of Scratch Tickets ordered. The number of actual prizes available in a game may vary based on number of Scratch Tickets manufactured, testing, distribution, sales and number of prizes claimed. A Scratch Ticket Game may continue to be sold even when all the top prizes have been claimed.

3.0 Scratch Ticket Ownership.

A. Until such time as a signature is placed upon the back portion of a Scratch Ticket in the space designated, a Scratch Ticket shall be owned by the physical possessor of said Scratch Ticket. When a signature is placed on the back of the Scratch Ticket in the space designated, the player whose signature appears in that area shall be the owner of the Scratch Ticket and shall be entitled to any prize attributable thereto. Notwithstanding any name or names submitted on a claim form, the Executive Director shall make payment to the player whose signature appears on the back of the Scratch Ticket in the space designated. If more than one name appears on the back of the Scratch Ticket, the Executive Director will require that one of those players whose name appears thereon be designated by such players to receive payment.

B. The Texas Lottery shall not be responsible for lost or stolen Scratch Tickets and shall not be required to pay on a lost or stolen Scratch Ticket.

4.0 Number and Value of Scratch Prizes. There will be approximately 5,040,000 Scratch Tickets in Scratch Ticket Game No. 2723. The approximate number and value of prizes in the game are as follows:

A. The actual number of Scratch Tickets in the game may be increased or decreased at the sole discretion of the Texas Lottery.

5.0 End of the Scratch Ticket Game. The Executive Director may, at any time, announce a closing date (end date) for the Scratch Ticket Game No. 2723 without advance notice, at which point no further Scratch Tickets in that game may be sold. The determination of the closing date and reasons for closing will be made in accordance with the Scratch Ticket closing procedures and the Scratch Ticket Game Rules. See 16 TAC §140.302(j).

6.0 Governing Law. In purchasing a Scratch Ticket, the player agrees to comply with, and abide by, these Game Procedures for Scratch Ticket Game No. 2723, the State Lottery Act (Texas Government Code, Chapter 466), applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140, and all final decisions of the Executive Director.

In accordance with 43 TAC §25.901 et seq., the Texas Department of Transportation (TxDOT) is requesting project proposals to support the targets and strategies of the Texas traffic safety program to reduce the number of motor vehicle related crashes, injuries, and fatalities in Texas.

Authority and responsibility for funding the traffic safety grant program derives from the National Highway Safety Act of 1966 (23 USC §401 et seq.), and the Texas Traffic Safety Act of 1967 (Transportation Code, Chapter 723). The TxDOT Executive Director is the designated Governor's Highway Safety Representative. The program is administered at the state level by TxDOT's Traffic Safety Division (TRF) through the Behavioral Traffic Safety Section (TRF-BTS). TRF-BTS manages the program through program managers for statewide projects and traffic safety specialists in 25 districts for local projects.
